Dr. Amar Deep Gupta is permanent resident in S 11/24 in Chowkaghat under jurisdiction Jaitpura in Varanasi district. Dr. Amar Deep is living with his joint family in his forefather house he is running "Deep clinics" in one part of the house S 11/23 in chowkaghat since long time.
On 28th December, 2007 anti encroachment expedition came in after noon with out giving prior information start demolished the medical clinic of Dr. Amar Deep in which medicine and surgical instrument of lakhs Rupees were buried in the ground.
On 29th December, 2007 before demolishing Dr. Amar Deep Gupta and his younger brother advocate Ratan Deep Gupta show all original supportive document which prove the property of Dr. Amar Deep Gupta family.
When Dr. Amar Deep was showing paper to Circul Officer Chetganj Mr. Ashok Kumar Verma then some anti element throw stone and C.O gets injury on his face in reactionary work Station officer, C.O, city magistrate and other policeman present at that time brutally beat Dr. Amar deep Gupta and Ratan Deep Gupta with stick and but of the gun until both of them faint. Policeman arrest both Dr. Amar Deep and Ratan Gupta.
After of the incidence wife of Dr. Amar Deep (Ms. Mamta) and Ratan Deep Gupta (Ms. Shikha) went to Jaitpura police station to know about her husband. Station in charge Hari Ram Maurya and other police officer start abusing with ugly word to both Mamta and Shikha. Police officer threat and start swinging stick to both women. From print media personnel both women came to know their husband is kept in Jaitpura police station.
Both women in police station saw Dr. Amar Deep Gupta was faint and Ratan Deep Gupta right leg broke and he was drenched with blood. Approximately at 1:30 pm Ratan Deep Gupta condition become critical due to bleeding and he was admitted to District hospital in Varanasi in police custody. Amar Deep Gupta also becomes serious and he was also admitted to District hospital at 9 pm in the night. On 29th December, 2007 this news was aired on the television.
Section that was filed by police officer against Dr. Amar Deep and Ratan Deep Gupta are 147/325/332/333/352/353/504/506 of Indian Penal code and cr. L A .A.
Both are suffering with psychologial problems.

Using testmonial therapy : debate among professionals in Varanasi

We have increase in war, bombing, increase in terrorist attacks, increase in genocide, torture and domestic violence. Violence at very grass root level increase. Women and child are tortures and we have seems what happening to the Human Race where is our peace. Peace of Gandhi is hidden and where is the peace which says. We see breakage in Human Values in code conduct.
The Question is how to bring back again bring a person to the normal level of thinking acting and feeling and how to rehabilitate, how to restore confidence in them in minimum expenditure and in a brief supportive ways. How to reach a common person who is most neglected tortured person of the society. How to give relief him of his trauma and how to tackle what is happening inside them. So, Dr. Inger Agger all ways from Denmark come to give her hopes to give us new method a new technique she work with a torture survivor and with the survivors of war which we cannot imagine
With this stimulating words Round Table discussion on “Using Testimony as a psychotherapeutic tool” starts on 25th September, 2008 in Diamond Hotel, Varanasi with the joint endeavor three organizations - Deva International School for Child Care (DISCC), People’s Vigilance Committee on Human Rights (PVCHR), Varanasi and Rehabilitation and Research Council for Torture Victim (RCT), Denmark.
The main motive behind this discussion was to know the feedback from the psychologist and psychiatry nearby Varanasi district on using Testimonial as a psychotherapeutic tool in India.
Ms. Shruti Nagvanshi Trustee of People’s Vigilance Committee on Human Rights (PVCHR) hearty welcome participation in this round table discussion on behalf of above three organizations and she deliver her best wishes for the success of this discussion. She also briefly presents the Curriculum Vitae of Dr. Inger Agger. Program was moderated by Dr. Tulsi. The discussion starts with the traditional Indian spiritual style by lighting candle.

Dr. Lenin Director of PVCHR presents the postive result after using Testimony Method in the work of his organization. Dr. Tulsi president of Deva International School for Child Care (DISCC) briefly presents the words of Dr. Inger Agger and Dr. Lenin Raghuvanshi and gave few strong point for stimulating this discussion. He says that violence, torture and terrorism have become global psycho- social and economic problems.
Floor was open for the discussion and the question arises in this round table discussion was entertained by Dr. Inger Agger and Dr. Lenin Raghvanshi. Few fact suggestions were tinted by the Psychologist and psychiatry and they saw main challenges in grass root movement which is based on psychiatry. There may be around 3,000 adequately qualified psychiatrists and 1000 clinical psychologist in the entire country of more than a billion populations. In U.P itselves there may only be less than 100 psychiatrists and 100 psychologists. The ratio of doctors is very less

For bringing testimony therapy as therapeutic intervention for cases of psychological trauma.
Interesting part of this therapy is that it has both Western element of Anger Management, Classical Conditioning and Eastern approach of relaxation methods and Meditation.
It’s a cost effective model of psychotherapy which don’t require clinics or hospitals but, directly one can do this intervention at the doorsteps of the victim. For ex. His house, community, in a forest etc.
The economic cost of the whole approach seems to be very less than regular psychotherapy session in a clinic or hospital.

People’s Watch in league with the Friedrich Naumann Stifung, began the National Project on Preventing Torture in India (NPPT) in January, 2006 with a grant from the European Union under the EIDHR. This project is operationalizing in 47 districts of nine states of India namely Uttar Pradesh, West Bengal, Bihar, Rajasthan, Orissa, Karnataka, Andra Pradesh, Tamil Nadu and Kerala.
Primary aim of the action is to initiate and to focus on torture focuses on torture practices routinely employed by Police. In this project we are mainly focusing especially upon safeguarding groups on the margins of Indian society, such as dalits, tribal groups, minorities, women and children.
The goal of this project is
Protecting potential victim of torture, particularly those belonging to vulnerable and marginalized communities.
Highlight individual cases of torture as they occurs
improving institutional responses to instances of torture by demanding state accountability
Advancing an ethics of responsibility and restraint among the law enforcement officers.
Educating and enlisting professional groups such as lawyers, social activist, doctors, psychiatrists, journalists and teachers in the campaign to prevent and eliminate torture
Raising public awareness of torture as an unlawful and wide spread abuse of police power
Promoting favourable policy outcomes in the form of new anti – torture legislation and commitment to existing international treaties.
The overall goal of this project is the prevention and reduction of torture in India, where police abuses remain an entrenched and often routine law enforcement strategy despite India’s status as the world’s largest democracy.
Project design reflects priorities set up by the European Commission’s EIDHR call for proposals- specifically, research on torture practice, and research on torture practices, legal supports for victims, awareness raising and legislative lobbying.
The project deal with frequent police practices like assault and physical abuse, custodial death, custodial rape, threat and psychological humiliation and deprivation of water, food, sleep and medical attention.
In the duration of two 2006- 2007, the project undertook 4425 fact- findings through district by district torture monitoring, providing the basis for 4215 targeted legal interventions performed by staff lawyers in each states.
In 2006 – 2007 the project conducted 171 state awareness conferences targeting a total of 15,568 participants from various professions implicated in the elimination of torture including lawyers, social activist, psychiatry, journalist and teachers.
Ultimately, one of the most enduring effects of the project was model that its sets for addressing issues of torture nationality. Recognizing that there are insufficient resources to stanch the practice of torture nationally, a key aspect of this approach is the “model taluk” in which monitoring and campaigning efforts will be intensely focused in one “taluk” (an administrative sub division of a district) in each states, with the goal of working towards the elimination of torture practices entirely. This model will create a paradigm for the prevention and elimination of torture on a much larger scale.
With the slogan “BREAKING MYTH, IMPUNITY AND SILENCE” People’s Tribunal on Torture was organized in respective nine states. Finally in the month of September National Tribunal on torture was organized in New Delhi with the selected cases from these nine states.
Lots of Human Rights tortured victim from survivor became bare foot worker and they are guiding others for the legal advocacy of their cases. The outcome research through the data collect through fact – finding clearly state that torture is a serious problem and to generate conviction of torture practices within a wider culture of rights, to improve enforcement of and adherence to existing constitutional guarantees, and to lobby for the UNCAT ratification and the stricter domestic laws in India’s parliament and individual state legislative assemblies.
With the ratification of UNCAT and domestic law we should also campaign and make pressure on policy maker to authorize and validate psychological mapping of the police torture victim as equal to medico – legal report. As lots of torture victim are suffering from psychological problems – Nightmares, Memories, Fear of going out, Self isolation, Panic attacks, Anxiety, Depression, Suicidal thoughts and Sleeping disorder.
One state used “Testimonial Therapy” with the support of a Danish based organization known as Rehabilitation and Research Centre for Torture Victim (RCT) under the guidance of psychologist Dr. Inger Agger. The cases for the Testimonial Therapy were selected from those 73 cases which were heeded in the people’s Tribunal. Now this Therapy is being used in different country like Sri Lanka etc.

Case Summary
A dead body without head was seen near the Gutter of village Rajpur, P.S- Rampur, District- Jaunpur. This information was received by the village Chaukidar Mangarupal. He lodged a report in P.S Rampur, Jaunpur against unknown person on 11.04.04. During the investigation Mahendra Patel son of Mohan Patel Contacted to I.O and said his father was kidnapped by Ramesh, Bal govind and Rajnath. He also said that the dead body which was recovered near the Nala was the dead body of his father. He also submitted an affidavit to the I.O. the investigating officer has made accused to the applicant Rajnath, Bal govind, Ramesh, Kashinath and Harishchandra. The alledged accused Surrendered in the court and after lambushing in jail more than 1 month, They have been released by the session court ordered. The I.O has submitted the charge-sheet against the above accused.
That the applicant received information that the alleged deceased mohan patel alive and living in Pune. They caught Mohan Patel there and gave him in the custody of Pune’s Police. The Police produced the Mohan Patel before the CJM Jaunpur and there on 10.04.06. His statement was recorded in u/s 164 CrPc, in which Mohan Patel stated that he had come to Pune due to the conspiracy of Lalman. He also stated that the Accused person is innocent and they are falsely implicated. Thus 5-innocent person have been tortured and their right to live with dignity have been violated. Even after the statement of 164 CrPc they are regularly appearing in the court of Jaunpur CJM. This is again torture. The petition u/s 482 CrPC had been filed before the Allahabad High Court for quashing the Charge-Sheet.

Folk school
Victim Meeting
On 19th May,2007 , a victim meeting (Folk school) was being organized in district Varanasi at Jan Mitra Kendra, Belwa, Taluk Pindra.
In this program fifteen victims were participated and five victims called Laudhar Nat, Raj Nath, Munni Lal, Nand Lal & Dev Nath Patel, were turned up to fight their case to get justice.
In this program Dr. Bahadur Singh Yadav, Member of UP. SC/ST Commission was also very seriously listened all the that were being narrated by the victims themselves.
After listening all the stories, he told us those cases that are belongs to Dalit community, case by case you people prepare the complain letters with documents and one day within a week, come to me in Commission office at Lucknow. Same day I would issue direct notice to S.S.P. & D.M. for immediate action and he also assured us that he would personally write a letter to the same, that they facilitate and help the DHRM & S.P.C. And he also committed us to come every 19th of the month in this Folk school.
Media Awearness Programme In Sonbhadra
20th,May,2007 District Level Awareness and Training Programs for Media was organized in Sonebhadra.
This program was inaugurated Sr. Journalist Mr.Vijay Shankar Chaturvedi and Mr. Durgesh Kumar DYSP; Sonebhadra. The program was being presided by Mr. Tripti Chaube, Sr.Journalist Hindustan Times. Mr. Vijay Vineet Tiwari Sr.Journalist, Mr. Shantanu Vishwas Sahara Samay and Mr. Shesh Narain Dixit Sr. Lawyer & Journalist were key speakers.
And closing session presided by Mr. Kamal Yadav, Kotwal, Robertsganj and key speakers are Mr. Sanjal Prasad Sr. Journalist Dainik Jagran, Mr. Abdul Kalam Azad, Prinicpal Darul Ulum, Shafiq Bhai Sr. Human Right Activists and movement leader, were also successfully participated in the program.
Welcome speech was being given by Mr. Moosa Mohd. Azami, S.P.C., UP. He described definition of human rights and type of torture. Mr. Bhabundar Ghasiya victim, described his own police torture story.
Approximately hundred Journalists participated in the program and it was being organized at Vivekananda Preksha Bhavan, Robertsganz.

· Human Rights street Movement
Nearly more than 200 marginalized community’s member, victims and human Rights defenders participated in Human rights street movement on 20th March 2007. They highlighted Supreme Court judgment on right of detainees in case of D.K.Basu through distribution of pamphlet, playing of banner on judgment and speech. We handed over the many applications to magistrate for appropriate action. Some cases as follows:
On 20.3.07 a letter was sent to SSP, regarding police refusing to register a charge sheet in case of rape of a minor girl.
The victim was a minor girl aged 14 yrs. of Belwa village in Phoolpur Police Station at varanasi district of UP. The alleged perpetrators were from bick-clin of Mr. Rajendra Tiwari, Belwa village, Phoolpur police station, Varanasi district, UP. India.
- The incidence accused on 20.2.07 at around 2 Pm.
- The Police failed to register a case against perpetrators on several complaints.
- It was informed that the employee of Mr. Rajendra Tiwari was accused.
- The victims was threatened not to disclose the matter.
- It was informed that probable reason for the police not registering the case is because of influence of Mr. Tiwari on police.
- PVCHR intervened the matter by documenting the matter. Simultaneously approached senior superintendent police through NPPTI urging to put pressure on police officers attached to police station who refused to take action.
- An application of Mr. Ram Bilas has been received in which his brother Mr. Ramesh has been missing from the Tehsil premises (Land Revenue Court)
- It is assumed that he has been picked on the directives of Mr. Kalpnath Ram who had been our opponent and is a influential person.
The matter was reported to S.O. Gorakhnath yadav of police station Robertsganj the application was torn and thrown down. The brother has not been located so far.
Human Rights Street Movement
Essentially, the Human Rights Movement approach is to improve equality in a society by improving the speech capacity of the poorer and the weaker section of the society. Improving their capacity to talk back and thereby creating a two-way discourse in the society is the way the concerns of the weak are brought to social discourse. The more silent the poor and the weak are, the less they will get from society.
Matters of justice depend very much on the capacity of concerned people to un-censor themselves and to speak out constantly. Normally there are many unwritten rules through which people censor themselves. For example, some topics may be considered taboo in some societies or sub sections of societies. For example, as an effect of feudal culture it is often observed that families of hunger victims hesitate and have subjective reservation to express themselves in respect of their acute poverty and hunger situations to which they have been going through.. For example it may be an unwritten rule that some “lower class people” do not talk back to “higher class people”. It may also be that some unwritten rules of censorship are enforced by punishments. For example some groups of people, if they talk about themselves and the wrongs that they bear they will be punished either physically or by other means. In all these instances the capacity to un- censor we is an essential component of seeking justice. When a small group of people begins to un- censor themselves others watch and soon begin to un-censor themselves as well. In this manner taboos invariably dissolve. The initial stages of un-censoring require:
1. Location from which you can break the rules of censorship while assuring protection for yourself.
2. The will to break such rules of censorship.
3. Creating an audience for you, which may at the beginning, is small.
4. Keeping at it day in and day out until taboos slowly begin to dissolve.
Accumulate information and protect documentation. This is a very important area of trying to create a discourse on justice and human rights issues related to Police Torture.
HR street movement is on district H.Q. Memorandum to H.E. President of India for rectification of CAT will handed over to DM and other petition of Individual victims will also give to him. Distribution of pamphlets and banner are creating awareness against torture in larger Civil society. Different stake holders will participate in that.
· Meeting of Victims at Jan Mitra center of Belwa in Model Taluka:
DHRM Prem with the help of PVCHR activists organized the meeting of victims of torture at Jan Mitra Center of Belwa in model taluka. Victims narrated their stories and sufferings. Project is planning the high level human rights campaign with the collaboration of different stakeholders of model taluka.
Advocacy:-
· Mr. Daya Shankar Patel,DHRM,Varanasi of project and Anupam of PVCHR invited by Member of State Human Rights Commission (SHRC).Mr. Daya informed about the project and he raised the police encounter and violation of NHRC guidelines .
· Organized the meeting of different stakeholders on 19 March 07 at Kamesh Hut Hotel, Varanasi.Dr. Bahadur Singh Yadav-member, SC and ST Commission of UP, and Mr.Hari Shankar Singh (advocate)–member, UP Bar Council participated also. After that member of SC & ST commission of UP telephoned to SD that he received many complaints received from project and he took action on every cases.

Visit of EU Monitor:
· ND,Mr. Gyanapraksham, Mr. Mohan Panda of FNSt came along with EU monitor between 19-21 March 07. They participated in stakeholders meeting, HR street movement, meeting of victims in Model taluka, and visited the office, talked with staff for participatory evaluation.
· SPC of Bihar organized the meeting of all staff on the request of SD and he gave his observation.
Immediate intervention in case of Human Rights defender:
· A Dalit Human Rights activist Mr. Ram Prasad Bharati was arrested by Sukrut police out post of Mirzapur and was carried to Naugarh police station of Chandauli.While in the way, he was beaten and abused. Immediately the matter was intervened by State Director of project through complaint before NHRC, AHRC and frontline in Irelend.He was released in evening.

· On the date 21 March 07, there was press conference at police control room of Varanasi about the arrest of two person in case of robbery, in which a journalist Ajay rai who was trained by us related to torture, he raised certain questions which the police was unable to reply and SP (City) went away from the conference. Whereas he informed to SD of project and SD and DHRM filed petition by Fax to SSP and NHRC. On this both arrestees were released. And responsible police official involve in arrest was suspended.

Human Rights street Movement is organized on 19 February 2007 with the collaboration of Musahar-Nut Adhikar Manch,VOP,PVCHR. All participants came from villages of model Taluka”Pindara”.Movement focused the torture of most marginalized in Pindara Tahsil of Varanasi .To highlighted about DK Basu ‘s Judgment and direction of Supreme court. To signed and sent to president of India about rectification of CAT by Government of India .Near about more than nine hundred people participated. Petition received by ACM of Varanasi.Project took up the four cases of torture of Marginalize community.
Awareness Programme:-
Organized the ten awareness meeting in model Taluka where we focused on illegal detention and Human Rights Institutions.
Advocacy:-
SD sent the letter to all political parties that they will include the rectification of CAT, police reform and rule of law in their political manifesto.
SD met with ADGP (Law) in Lucknow and briefed about project.
Other Activities:-
Dr. Bahadur Yadav, Member of SC and ST commission of UP gave the consent to hold the membership of advisory council of Project.
Camp of victims at Sonbhadra and Allahabad as reflection and follow up of cases on 22 feb. 2007 and 23 Feb. 2007 respectively.36 victims in Sonbhadra and 13 victims in Allahabad participated. SLO decided to intervened nearly 13 cases through participatory involvement of every stakeholder.

Our case of no proper treatment of a prisoner Chegvevara in Varanasi jail, our partner organization took this case before NHRC and other police officials and Jail and District administrations provided the medical treatment to him .Project filed the writ petition in this case before the high court of UP in Allahabad and Court gave very positive judgment in this case.
Model Talluk:-
On 25/01/2007, The Pindra Tehsil was proposed to be adopted as a Model Taluk. For which S.D Dr. Lenin & S.P.C Mohd. Moosa Azami organized a press conference which is held in Pararkar Bhawan Maidagin, Varanasi. In which journalist & media persons were participated. The aspects that Pindra Tehsil {Model Taluk} should declared to be a very sustain people’s campaign against torture.

Human Rights street Movement is organized in Chadauli District on 16 January 2007.March with torch against torture is key element of HR street Movement which is received a lot of attraction and participation of civil society of areas.

State Director Lenin visited the Sonbhadra along with DHRM .He intervened in a case of youth and student leader, who is victim of torture by Police and administration through falsely implication of him under Gunda act. SD called to DM and appealed to revoke the Gunda Act from him. He collected the all fact and he highlighted the technical fault in order of Gunda Act. After that DM revoked the Gunda Act.

European Union supported National Project on "Preventing Torture in India: from Public Awareness to State Accountability"
European Union supported National Project on "Preventing Torture in India: from Public Awareness to State Accountability"
European Union has formally approved this national level project in the last week of December 2005 and it comes into effect from January 2006 for a period of three years. The aim of the action is to initiate and model a national campaign for the prevention of torture in India, with a deliberate focus on torture practices routinely employed by police. This project will be carried out in 10 States: Tamil Nadu, Kerala, Karnataka, Andhra Pradesh, Rajasthan, Orissa, Uttar Pradesh, Madhya Pradesh, West Bengal, and Bihar.
The overall goal is the prevention and reduction of torture in India, where police abuses remain an entrenched and often routine law enforcement strategy. And its scope will include interventions against instances of assault and physical abuse, custodial death, custodial rape, threats and psychological humiliation, and deprivation of food, water, sleep, and medical attention.
protect potential victims of torture, particularly those belonging to vulnerable and marginalized communities,
highlight individual cases of torture as and when they occur,
improve institutional response to instances of torture by demanding state accountability,
advance an ethic of responsibility and restraint among law enforcement officers,
educate and enlist professional groups such as lawyers, social activists, doctors, psychiatrists, journalists, and teachers in the campaign to prevent and eliminate torture,
raise public awareness of torture as an unlawful and widespread abuse of police powers,
promote favourable policy outcomes in the form of anti-torture legislation and fulfilling of commitments to existing international treaties.
Two stages will drive the action’s overall agenda: first, the formation of ten state-wide networks to monitor instances of torture and intervene on behalf of individual victims; and second, a national awareness campaign that uses this monitoring data to generate public and professional condemnation of torture practices within a wider culture of rights, improve enforcement of and adherence to existing constitutional guarantees, and lobby for CAT ratification and stricter domestic laws in India’s Parliament and the individual state legislative assemblies.
The district-by-district torture monitoring will be conducted by a corps of 100 torture monitors across the ten states, drawn from local affiliates coordinated by FNF’s partner People’s Watch Tamil Nadu. Torture monitors will investigate abuses as they occur in real-time—interviewing victims, witnesses, and police, collecting documents, and mobilizing local media coverage. These fact-finding missions will subsequently provide the basis for targeted legal interventions, primarily in support of individuals from marginalized groups, performed by staff lawyers in each state.
The national awareness campaign coordinated by project staff will employ the raw data generated by these monitoring activities to drive media coverage, public education, and lobbying activities devoted to bringing greater visibility to the prevalence of torture in India. Reporting on individual instances of abuse will be matched by activities that aim to broadly educate public audience as to their rights and the legal resources available to them. On a policy level, the campaign will push to increase these protections. It will also include at its core a series of state-level awareness conferences targeting the various professions implicated in the elimination of torture: lawyers, social activists, doctors, psychiatrists, journalists, and teachers. Police themselves, as well as members of the judiciary, are also to be treated as intermediaries, receiving awareness training that addresses them as constructive partners rather than adversaries in this project
